An attorney from Yachats is in the Lincoln County jail on robbery, assault and disorderly conduct charges after getting into a fight Wednesday with a clerk at Big 5 Sporting Goods in Newport over a disagreement about purchasing two .22 caliber rifles.
Newport police arrested Rachel Marshall, 69, on accusations of third-degree robbery, fourth-degree assault and second-degree disorderly conduct after she tried to leave the store with the rifles and fought with the clerk.
Marshall was arraigned on the charges Thursday, which was continued until March 9. Linn County Circuit Judge Rachel Kittson, who was brought in to hear the case, set bail at $75,000.
Marshall has a legal defense practice in Newport, which indicated it was temporarily closed this week.
A probable cause affidavit by Officer Abraham Felix said Marshall bought the rifles Monday and the store called her Tuesday to say that Oregon State Police cleared her to pick them up. But when Marshall got to the store, the clerk told her she needed to re-sign the paperwork and get re-certified.
The affidavit said Marshall objected, tried to leave with the rifles and she and the clerk began fighting over the weapons inside the store and outside near Marshall’s car.
Police arrested Marshall, who the affidavit said was wearing a mask and sunglasses. Jail staff later found a small magazine loaded with .22 rounds in her pant leggings.
A condition of her release says Marshall needs to have Newport police remove weapons from her impounded car and that she shall not own or possess any firearms, ammunition or dangerous weapons while the case is pending.
